Terms of Use

These Terms of Use ("Terms") govern your use of Pending, a private group-poll app operated by Allen Tackie ("we", "us"). By downloading or using Pending, you agree to these Terms. If you don't agree, don't use the app.

1. Eligibility

You must be at least 13 years old to use Pending. By using the app you confirm that you meet this requirement and that any information you provide is accurate.

2. Your account

You may use Pending anonymously on your device or by signing in with Apple or Google. You are responsible for activity that happens under your account and for keeping your sign-in secure. You can delete your account at any time from within the app.

3. Acceptable use

Pending is for fun between friends. You agree not to use it to post, share, or promote content that is:

Zero tolerance. We do not tolerate objectionable content or abusive users. We may remove content and suspend or ban accounts that violate these Terms, and we aim to act on valid reports of objectionable content within 24 hours.

4. Your content

You own the polls, votes, comments, and other content you create. By posting it, you grant us a limited license to store, display, and share it within your groups and features (such as weekly recaps) so the app can function. You are responsible for the content you post and confirm you have the right to post it.

5. Reporting and moderation

Pending provides tools to report content and block other users. We may review reported content and take action, including removing content and removing users from the service. You can also leave any group at any time.

6. How anonymity features work

Some features hide who voted. Ghost Mode keeps a vote anonymous permanently. Time Bomb hides a vote at the reveal but automatically reveals it about 24 hours later. Standard votes are revealed to your group when a poll's results are shown. We provide these features as-is and cannot guarantee that other members won't infer how you voted.

Pending is provided "as is" and "as available", without warranties of any kind. We do not guarantee that the app will be uninterrupted, error-free, or that content will be accurate. Use it at your own discretion — and keep the roasts friendly.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages arising from your use of Pending, including from content posted by other users. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $50, whichever is greater.

10. Termination

You may stop using Pending and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the service and its users.

11. Changes to these Terms

We may update these Terms from time to time. We'll revise the "Last updated" date and, for significant changes, notify you in the app. Continued use after changes means you accept them.

12. Governing law

These Terms are governed by the laws of the Republic of Ghana, without regard to its conflict-of- laws rules.

13. Apple

If you download Pending from the Apple App Store, Apple's standard Licensed Application End User License Agreement (EULA) also applies. Apple is not responsible for the app or its content, and Apple is a third-party beneficiary of these Terms with the right to enforce them.
